The surface dedication plan marks a regulation of the municipality (see municipality planning) consisting in the Austrian right, of a text and a description of plan. A surface dedication plan covers the entire Gemeindegebiet and on basis of the land register plan is provided. It assigns to each property a certain dedication, which specifies, like property to be used can (development land, grassland/open land, traffic surface, other specifications). For the distribution of a building permit in most cases a development land dedication is necessary. Surface dedication plans are subject to the local space planning of the supervision as regulations in the framework by the respective federal state government, which has to approve or malfunction the plan after technical and legal examination for agreement with the underlying law.

Further evident making must be registered in the surface dedication plan. Evident making concern planning-relevant right subjects, which lie outside of the municipality authority. These are among other things:

  • All surfaces which by legally effective over-local planning for a special use are certain (e.g. priority locations, motorways, public waters).
  • All surfaces and objects, on due to federation or Landesgesetzen the restrictions of use exist (e.g. monument cannons building, protected areas).
  • All surfaces, which are e.g. impaired by natural dangers (flood endangered areas).

Since the legislation lies for local space planning and to the associated surface dedication plans in Austria in the authority of the countries, there are therefore 9 different regional planning laws with different in each case definitions concerning contents and the representation of the plans including regulation wording.

Thus different categories exist:

Surface dedication plan in the Steiermark

The surfaces divided into:

  • Development land areas
    • Adequate development land: opened and does not endanger or impairs
    • Reorganization areas: cultivated however endangered, impairs (noise), not sufficiently opened (waste water)
    • Unlocking areas: vacant, nor endangered, not yet sufficiently opened
  • Traffic surfaces
  • Open land

In the development land the following use categories are intended:

  • pure populated area
  • general populated area
  • Holidays populated area
  • Village area
  • Line of business, core and office
  • Construction sites for shopping centres 1
  • Construction sites for shopping centres 2
  • Trade areas
  • Industrie and trade areas 1
  • Industrie and trade areas 2
  • Recreation area
  • Cure area

All as development land or traffic surfaces of fixed ranges are to be assigned to the open land. This is usually intended for the agricultural use. Management of works are here permitted to the land and forestry with few exceptions exclusively in the framework. In the open land however also special uses are possible:

  • Recovery and sports areas, park, acquisition market gardens, various plants
  • Replenishment areas (small-scale settlement ranges with slight replenishment possibilities)

Surface dedication plan in the castle country

The surfaces divided into:

  • Development land areas
    • Development land
    • Unlocking areas (yet not opened)
  • Traffic surfaces
  • Grassland
    • All the agriculture not serving surfaces in the grassland are to be proven separately

In the development land the following use categories are intended:

  • Populated area
  • Village area
  • Line of business
  • Operating area
  • Industrial area
  • Mixed construction site

Surface dedication plan in Lower Austria

The surfaces divided into:

  • Development land areas
    • Development land
    • Unlocking zones
  • Traffic surfaces
  • Grassland

In the development land the following use categories are intended:

  • Populated area
  • Agrarian area
  • Central area
  • Shopping centres and specialized markets (become outdated, may not again be proven any longer)
  • Operating area
  • Industrial area
  • Special area
  • Area for receive-worth local structures

Surface dedication plan in upper Austria

The Gemeindegebiet is divided in principle in development land, traffic surfaces and grassland.

In the development land again distinctive in:

  • Populated areas
  • Village areas
  • Cure areas
  • Central areas
  • mixed construction sites
  • Operating construction sites
  • Industrial areas
  • Second home areas
  • Areas for buildings of business
  • Special areas of the development land

As traffic surfaces surfaces for flowing and resting traffic are to be planned.

The grassland serves in principle the land and forestry or as wasteland is proven. In addition special dedications (e.g. recreation areas, green courses, acquisition market gardens, Abgrabungsgebiete etc.) can be specified. In the grassland only in principle those buildings may be established, which are necessary for the use specified in each case. In exactly defined cases are permissible exceptions (e.g. replacement of existing housings in the grassland).

Germany

In Germany the corresponds to a large extent to the surface dedication plan. Substantial difference is however that the in Germany becomes obligatory for the property owner only in the subordinate development plan concretized and.
