In Switzerland the mortgage does not exist legally and only colloquially for the appropriate loan is used. Instead the Swiss civil code (ZGB) defines the following three forms of the mortgage on real estate:
Schuldbriefe and mortgages are securities in the classical sense and can be acted. If the paper should be somehow destroyed, the appropriate basic load entry in the land register must be deleted. Nowadays Schuldbriefe are practically only established, since mortgages have an extremely ponderous notice character and their historical meaning because of still legal were embodied (since the introduction of the ZGB in the year 1912 in whole Switzerland hardly more than two dozen new mortgages was established).
