The graduated rent is a form of the rent, with which in a while ago is fixed already, to which extent itself the rent at certain times increased.

It is regulated in BGB "§ 557a. In the agreement the respective rent or the respective increase in a money is to be proven. The respective renting relay must apply at least 1 year invariably. Further increases are inadmissible for the period of the progressive rate - this applies also when modernizations in this period. Excluded is only the operating cost. Also in unlimited leases graduated rents can be agreed upon. With expiration of the progressive rate the rent can be increased here only dependent on the local comparative rent. The exclusion of a right to give notice of a commercial tenant or during an individual agreement is limited with a relay lease to four years.

In the comparison with the index rent, and the delimitation otherwise planned for dwelling the question arises rent increases up to the local comparative rent after BGB "§558, where the agreed upon progressive rate is in relation to the general value development. This deviation is to be considered in the context of the valuation, since due to the temporal stipulation of a time limit of each progressive rate only from the local comparative rent can be proceeded on a long-term basis. As a rule a graduated rent might lie over the general price history, why with application productive value procedure can be appropriate for the time at the expiration of one notice waiting period a decrease.
