Since 1 January 2004 the floor space regulation (WoFlV) applies. The regulation be based on "§"§ the 42 44 of the IITH computation regulation and replaces these. It contains the legal definition of the floor space. To older leases further the old beginnings apply.
The differences are:
- The constant point at issue, to what extent balconies, loggias, roof gardens and terraces to the floor space belong, was now going by clarified that these are to be usually included to a quarter to the floor space, at the most however to the half (in exceptional cases, for example with organization, also fully). A Sichtschutz (so mentioned "taken off free seat") is not now any longer presupposed.
- A general departure for finery at a value of 3% is not intended any longer. With the determination of surface areas also the surfaces can be included now by oriels and even if these exhibit a floor space of less than 0.5 square meter.
- In the future also the surface areas are considered clothing, free standing columns and columns by chimneys, Vormauerungen, if they exhibit a height of at the most 1.5 m and square meter does not exceed their surface area 0.1, since they are usable as file possibility.
- While in the past space parts under stairs were not counted to the floor space, if they had amounted to a headroom of less than 2 m, these can be included in the future to that extent to the floor space, when these are higher than 1 m. But a charge takes place at a height of 1 m to 2 m only to the half and a complete charge of the surfaces only if they are higher than 2 m.
- As far as winter gardens heatable are not, these can be only included to the half to the floor space. If these are however heatable, winter gardens can be included fully to the floor space. So far the charge was here contentious whether these areas only a covered free seat would be comparable.
- The past departure from overall 10% with buildings with only one dwelling was omitted
