The annuity charge exists in the load of a property in the form that in regularly returning dates a certain sum of money from property is to be paid (pension). This is thereby a special form of the land charge. - After a notice with period of i.d.R. 6 months - the right is entitled to the debtor (owner) to replace its debt against payment of a unique amount. The height of this amount of replacement must be determined with order of the annuity charge and registered in the land register.

The creditor can replaces not to require, it is, the security of the annuity charge is endangered and the endangerment within an appropriate period is not eliminated by degradation of property. Removal of the endangerment is possible by improvement on property or by order of other one mortgage lien.

In Germany the annuity charge is regulated in "§"§ 1199 FF BGB.

If a creditor wants to avoid that the debtor becomes detached through from the pension payment obligation release can, then it let secure alternatively the possibility (in agreement with the debtor), the pension payment by the entry of a perpetual charge into the land register (abbott II).
